Infosys is currently under investigation by the U.S. Department of Justice regarding its H-1B visa filings, following a previous settlement over immigration violations in 2013.

Infosys Ltd., a prominent Indian IT services company, is engaged in discussions with the U.S. Department of Justice (DOJ) concerning an ongoing investigation into the classification of certain H-1B visa holders in immigration documents submitted to U.S. authorities. This revelation was made in the company’s financial statements for the quarter and half-year ending September 30, 2026.

In its filing, Infosys stated, “The Company is engaged in discussions with the DOJ regarding its ongoing investigation and continues its own inquiry regarding the matter.” The company also noted that it is unable to predict the outcome of the investigation or assess whether it will have a materially adverse impact on its business and operating results. This disclosure is included in the “Government Investigation” section of its legal proceedings.

This investigation marks a significant moment for Infosys, coming more than a decade after the company settled a previous U.S. government probe into alleged immigration violations for $34 million in 2013. That settlement addressed allegations that Infosys had improperly utilized B-1 business visas for employees performing work in the United States and had provided misleading information regarding the purpose of some employees’ visits. The DOJ also highlighted violations related to employment eligibility verification records.

As part of the 2013 settlement, Infosys agreed to pay a penalty and enhance its compliance procedures, which included undergoing independent audits of its employment verification practices. While the company disputed allegations of widespread visa fraud, the settlement allowed it to resolve the government’s claims without facing criminal charges.

The current investigation appears to focus specifically on how certain H-1B visa holders have been classified in the company’s immigration documentation. Infosys has not indicated whether this current probe is related to the issues addressed in the 2013 settlement.

As the situation develops, Infosys continues to navigate the complexities of U.S. immigration regulations and the scrutiny that comes with operating in a highly regulated environment. The outcome of this investigation could have significant implications for the company, particularly as it seeks to maintain its standing in the competitive IT services market.
